In August, Opinion in Avrahami v. Commissioner was released by the U.S. Tax Court. In the decision, the court found that the captive was not functioning as a legitimate insurance company. While the court’s ruling was very specific to the Avrahami case, the finding still has major ramifications for 831(b) microcaptives.
